Take part in the congress!!!

26. 07 2000 in Grodno the constituent congress of the republican structure of businessmen will take place.

What it will be: a Union of the businessmen of Belarus or a trade union of businessmen of Belarus the Congress will decide. The realisation of the congress was repeatedly put off. In Minsk we were refused in a room for the realisation of the congress. Then there was no money for the realisation of the congress as a lot of means were spent for the realisation of the large charitable actions. Now situation has changed. We have enough money. If we are not given a room for the realisation of the congress, we shall go to the country and we shall carry out the congress there.

The constituent congress will last one day. The transport charges, charges on a hotel and meal, if necessary, will be compensated. The earnest request: please try to save means of the organisers of this congress. Do not forget that the congress is carried out on money of the same businessmen as you.

Representation on the congress is one vote from 20 accredited representatives, i.e. the participant of the congress having twenty signatures has one vote, 40 signatures - two votes etc.

At the registration it is necessary to have the documents confirming the powers of a delegate:

- An extract from the protocol of the assembly or a warrant of attorney from the accredited representatives of an any example (to assure by the notary it is not necessary, it is possible to assure by a seal of yours trade union or without assurance)

The form with the signatures of the founders which is represented by the delegate. The example of the form see lower. It is desirable to fill in the forms on the computer (type 14), but it is possible to fill in the forms in the written form, only by legible hand and printed letters. The surname, Name, Patronymic is underlined completely. The serial number is not underlined.

What for do businessmen need the trade union is necessary?

Three years of struggle. The struggle for a survival. Victories and failures, meetings, strikes, new persons and new leaders.

It seems that the rest which has come after January’s and February’s events ends. In Gomel the confiscation of the goods for the absence of invoices on purchase of the goods takes place to the utmost, in Minsk - for the certificates. On all country there is a wave of documentary checks at the businessmen for 1997-1999 years. The purpose is one to withdraw the property from businessmen, imposing of the huge fines and sanctions.

The simple analysis shows that the authority prepares a new wave of punitive measures. Not to allow a new wave of strikes we are offered pseudo-leaders, provocateurs or pocket trade unions. For what? To weaken positions of the strike committee and to bring the discord into the businessman’s environment. Then it will be possible to finish with everyone. Strike is an extreme measure, but not a unique one. The strong independent structure which can solve questions at a state level by a "peace" way is necessary for us. Without the lawyers, without a room, without means of electronic communication there can not be an organisation. You were convinced that our strike committee cannot be bought or intimidated or destroyed. It is not registered anywhere, but it was, is and will be. Yes, we part with the traitors, over-turners and glues. But what to do? Such time. Or we shall create the rigid disciplined structure or everyone "will pull a blanket on himself". The state will recognise only a strong organisation, and we offer you to create it. The creation of the following structure is planned. It will consist from:

- a republican body which decides questions at a state level, develops the legislative acts, offers changes in the present legislation, carries out talks with authorities.

- primary organisations in cities and regional centres, which at desire can be allocated with the right of a juridical person.

Together in prospect we can open the informational-legal centres (ILC) for businessmen. But the basic task of a created trade union is the prevention of a forthcoming wave of confiscations and penalties.

Each member of the trade union (union) in course of time can get all necessary legal information, this bulletin and to expect for the free-of-charge legal help.

Legal activity needs state registration. Yes, we today are registered in free and independent trade unions. But do not forget that these trade unions are created for the workers and they have their own specificity of work and problems. We shall be and further to co-operate with them, but within the framework of independent structure, about which we have already agreed.

The information message

Since 25.05.2000 under the initiative of the Grodno businessmen and Grodno Public Female Organisation (GPFO) "The Spring of Mercy" the next stage of the charitable action "OUR CITY" will be carried out in Grodno.

The action will last till June 25, 2000. Many new and second-hand things which have begun to distribute within the poor are collected.

31.05.2000 the Grodno businessmen presented 15 cakes and 14 souvenirs to the persons keeping their name-day and pupils of the Children's House. 1.06.200 more than 100 children from needy families and families where a lot of children are brought up and the children from the Children's house visited Puppet theatre, rolled on merries - go-round, got biscuits, bananas, oranges from the Grodno businessmen.

On behalf of the organisers of this action we express a huge gratitude to the businessmen of the Ware market in the village Southern in Grodno (the chief is Alexander Vasiliev), the Grodno branch of the Belorussian Helsinki Committee (the chief is Alexander  Antonuk), the Grodno Public Female Organisation "The Spring of Mercy" (the chief is Marina Samoil), the Belorussian Organisation of the Working Women (Marina  Levonevskaya), the Grodno regional organisation of the Protection of the rights of the consumer (the chief is Vladimir Sovtsa), the United Civil Party in Grodno and Grodno region, working women of the joint company "Alforma" (Irene Bairashevskaya), many businessmen, firms and citizens for the active help in the realisation of this holidays for children.

The Grodno businessmen and Grodno branch of the Belorussian Helsinki Committee have decided to take the mothers and children from "The Spring of Mercy" under the complete legal protection. The legal assistance will be rendered free-of-charge. Now any official who has dared to offend or to restrain the rights of a mother or a child will answer for his actions before the law. The first results have already been got.

7. 07 2000 at the general meeting of the Grodno Centre of Protection of the Rights of the Consumers the Vice-president of the Centre A. M. Shulga was removed from a post, removed from the structure of the leaders and removed from the members of the Centre for rough numerous breach of the Charter, forgery of the signatures in the official documents of the Centre.

During the carried out check initiated by the President of the Centre it was found out that during the long time in the city the group of the persons who gave themselves away for the Centre of Protection of the Rights of the Consumer headed by A. Shulga worked. However they were not connected with the Centre. So, everyone who has suffered from the activity of this group and "checks" spent by them can address to the President of the Centre for the consideration of a question connected with the cancellation of results of these "checks" (tel. 31-30-62).

The mothers of large families have achieved their purpose.

From 15. 05. 2000. the hunger-strike of Grodno mothers of large families to protest against an arbitrariness and mockeries of the municipal officials should begin. 02. 05 2000 about this event in written form was said to the executive committee. 12. 05 2000 when the mothers of large families came to the municipal executive committee they were pleasantly surprised. It appears the municipal executive committee has given a room for the female organisation «The Spring of Mercy». Within a day the contract of the rent was signed, the warrant and keys from a room were given to the women. Usually this procedure is delayed on two, three weeks. The municipal executive committee has given a room in one of the most prestigious districts of the city, in the city centre, on the Soviet square, in the hotel "Neman". Moreover, the rent payment for the rented room was reduced in 10 times in comparison with the standard payment to «The Spring of Mercy» and will make 0,6 dollars. USA for square meter. 12.05.2000 the author of these lines was pleasantly surprised when he “as the representative of the Grodno businessmen and the organisation on protection of the human rights was present at visiting of the municipal executive committee by the mothers of large families. This day the officials of all levels paid a lot of attention and any amount of working and non-working time to the mothers of large families, in all studies the representatives of the female organisation were the most desired visitors. We want to see always such attitude! We hope, that the municipal executive committee will help the mothers of large families in the future and will not create disputed situations. And the head of municipal executive committee A. Pashkevich will invite the mothers of large families to himself to expand the further co-operation in the field of protection of motherhood and childhood in Grodno.

The note: Recently it is difficult to find A. Pashkevich. In different studies of the executive committee the different versions were put forward: he was ill, was on business trip, somewhere else etc.

The mothers of large families recalled their application from 02. 05. 2000 about the hunger-strike. And the Grodno businessmen will not insist on removal from the post of the chairman of the municipal executive committee A. Pashkevich on this case and stop the appropriate actions of the protest.

The question - answer

Question: When I am called to the tax inspection by a notice whether I am obliged to go there? Can I be brought there by force?

Answer: You are not obliged. The compulsory taking into custody is supposed only by the decision of the court or an inspector. The taking into custody on the initiative of the tax inspector is an exceeding of authority and service powers (it threatens till 3 years of deprivation of freedom to this inspector).

Question: The documentary check for 1997 is carried out, the documents on the purchase of the goods are demanded. Everyone understand that I have no these documents now. Thy send a lot of registered letters. What shall I do?

Answer: To can get the registered letters it is your right, but not a duty.

Many do so: ask a postman to send the letters back or when the check is carried out they rent the neighbouring apartment. The members of family answer that such man does not live here. They say that it is cheaper than to pay the mad fines for breaches which were not committed. And the time works on a "breacher". We hope that there will come times when people who pay taxes will not be persecuted.
